What is theft?

According to section 377 of the Indian Penal Code, any person who transfers immovable and movable property in the possession of another person without the consent of that person for the purpose of embezzlement is called a thief.

Conditions of law

  • Anything as long as it is attached to the soil is not transferable, so it is not possible to steal, but the moment that thing is detached from the soil, it can be called theft.
  • When a person attempts and removes something for the purpose of stealing, it is considered theft.
  • Even if his tree is cut down and left in another place without the consent of the owner, it is tantamount to theft.
  • If an item is intercepted, it is considered as theft and if it is removed with malicious intent, it will be considered as theft.

How to report theft

What must be mentioned when filing a theft case is how it was stolen and where it was stolen from. When was the time stolen? Where were you when the theft happened and when was the stolen item bought or found? Whether there is any receipt even after buying that thing.

Penalty for theft

  • Theft may be punishable by up to 3 years imprisonment or fine or 2 under Section 379.
  • Anyone who enters the house with the intention of stealing and without permission will be liable to seven years rigorous imprisonment and fine under Section 302 of the Indian Penal Code.
  • If an office worker or clerk steals property in the custody of its owner, he is liable to imprisonment for seven years and fine under section 370 of the Indian Penal Code.
  • It is often seen that stealing, possessing a weapon, threatening a weapon, or injuring a person is punishable by up to 10 years rigorous imprisonment and fine under Section 370 of the Indian Penal Code.

Penalty for robbery is ineligible for bail under Act No. 382

When five or more persons collectively try to commit robbery and their conduct is of a completely different quality then those persons will be charged under Section 391 of the IPC. When filing a robbery case, it is important to know how many criminals were using which weapon and which person was injured.

Punishment of robbers

Under Section 379 of the Indian Penal Code, any person who uses a deadly weapon during a robbery or robbery and attempts to kill someone with a weapon is liable to seven years rigorous imprisonment. And if a person kills or kills while committing robbery, the murder of each person will be punishable by death or life imprisonment as per section 306 of the Indian Penal Code and up to 10 years rigorous imprisonment and fine. Section 339 of the Indian Penal Code also carries a maximum penalty of 7 years rigorous imprisonment and fine for those who were present at the time of the robbery but did not commit the robbery. One more thing to keep in mind is that no matter where the incident takes place, you can lodge a complaint with any police station, but the first responsibility of sending your complaint to the concerned police station is your own.
